In this second part interview, Mr. Arcadier is interviewed by Larry King. Mr. Arcadier represented the whistleblower employee who brought to light some of the issues surrounding Sea World at that time, which arguably, was a contributing factor to the many changes which have henceforth transpired.

In this second part segment, Larry King interviews experts with competing viewpoints and engages Mr. Arcadier to explain state and federal whistleblower laws and how it applies to the instant matter.

State and Federal Whistleblower laws prevent an employer from taking retaliatory action against an employee who has engaged in protected activity. Protected activity means the disclosure of activity which is illegal or that it violates a law, rule or regulation. The activity must be reported to the appropriate government agency. Under Florida Law, the private whistleblower act is codified under Florida Statute 448.102. The law provides a prevailing plaintiff with damages which may include attorney fees, costs, back pay, and reinstatement or other injunctive relief as applicable based on the facts. Additionally, Federal Law provides numerous whistleblower protections including protection for employees who file OSHA reports or disclosures.

In this particular case, the protected activity involved the disclosure of information to OSHA.

In the one-hour long interview with Larry King’s Maurice Arcadier represented his client’s position. The case is now resolved.
